EEOC Asked to Investigate AI Hiring Algorithms

Ten Senators have written the Equal Employment Opportunity Commission (EEOC) asking them to investigate possible discrimination in AI hiring algorithms. This included asking if they have the authority to perform an investigation into the AI hiring technologies themselves without any specific charge of discrimination.

Further, the Senators asked the commission three more specific questions. Could the EEOC request the hiring assessment tools, algorithms, and applicant data to use in testing whether these tools produce discriminatory results? Can the results of this study be published in a report publicly? Finally, what additional authority and resources would the EEOC need to proactively monitor this technology?

Regardless of the EEOC’s responses, this news should serve as an alarm for AI hiring vendors as well as those who use them. This report shows the intention of Senators to direct the EEOC to begin investigations and enforcement actions directed at both the makers and users of this technology.

This does not mean that employers should stop AI hiring algorithms and other hiring technology, but it does mean more to consider.
