Department of Justice Announces Availability of Application for Presidential Marijuana Pardon March 23, 2023 The U.S. Department of Justice (DOJ) made an online petition available for eligible individuals to receive a pardon certificate. This certificate shows that the President of the United States pardoned them for simple possession of marijuana. The "Application for Certificate of Pardon for Simple Possession of Marijuana," is available on the Office of the Pardon Attorney's website. The pardon by the President could help people by eliminating legal or civil disabilities. For example, it could give them the right to hold office or vote. In addition, people who receive this proof have a better chance of obtaining bonding, licenses, or other items that increase the ability to get a good job. It could also prove helpful when applying for housing. In October 2022, the President first granted a complete pardon to all United States citizens and lawful permanent residents with simple possession of marijuana on their records. However, this pardon excluded all other offenses. Furthermore, it excluded non-citizens and those not lawfully present in the United States when the offense occurred. In addition, the Attorney General will act through the pardon attorney to administer and accomplish the issuing of the certificates of pardons to eligible individuals. A pardon means the individual receiving forgiveness for the offense. Furthermore, it does not declare or prove any innocence of the crime. It also does not mean the conviction received expungement. Finally, receiving this pardon is federal forgiveness, but it does not apply to convictions under state law. The only exception to this clarification is the District of Columbia's criminal code, which will accept federal forgiveness on the state level. The Department of Justice will carefully review the information in certificate applicants to determine eligibility. It will then send out certificates to those the agency deems eligible. As a result, candidates with current marijuana convictions may soon receive pardons. Therefore, employers should pay particular attention to potential candidates and consider their options regarding simple marijuana convictions.
